PUBLIC AGREEMENT (OFFER)

For the Ordering, Purchase, Sale, and Delivery of Goods

This agreement between Sole Proprietor "Tsyganenko I.D." (hereinafter referred to as the "Seller") and the user of the website's services (hereinafter referred to as the "Customer") is a commission agreement for the ordering, purchase, and delivery of goods. It sets out the basic terms for ordering, purchasing, and delivering goods via the website https://happyluna.com.ua. By acting to purchase goods, the Customer accepts the terms of this sale and purchase agreement (hereinafter referred to as the "Agreement") under the following terms and conditions.

1. DEFINITIONS OF TERMS

1.1. Public Offer (hereinafter referred to as the "Offer")
A public proposal by the Seller addressed to an indefinite number of individuals to conclude a remote agreement for the sale of goods (hereinafter referred to as the "Agreement") under the terms stated in this Offer, including all Appendices.

1.2. Order
The Customer's decision to order goods and their delivery, as arranged through the website and/or delegated to purchase and deliver goods.

2. GENERAL PROVISIONS

2.1. The following information constitutes an official proposal (offer) by the online store https://happyluna.com.ua to any individual (hereinafter referred to as the "Buyer") to conclude an agreement for the sale of goods. This agreement is public, meaning that under Article 633 of the Civil Code of Ukraine, its terms are the same for all Buyers.

2.2. In accordance with Article 642 of the Civil Code of Ukraine, the full and unconditional acceptance of the terms of this proposal (Offer), which confirms the conclusion of the Agreement for the sale of goods under the terms stated below, is the act of placing and confirming an order.

2.3. By placing an Order, the Buyer confirms agreement with and unconditional acceptance of the terms of this Offer.

2.4. By concluding the Agreement (i.e., accepting the terms of this Offer by placing an Order), the Buyer confirms the following:

The Buyer is fully informed about and agrees to the terms of this Offer.
The Buyer consents to the collection, processing, and transfer of personal data under the conditions described below in the Privacy Notice on the collection, processing, and transfer of personal data. This consent to process personal data is valid throughout the term of the Agreement and for an unlimited time thereafter. Furthermore, by entering into this Agreement, the Customer confirms they have been informed (without additional notice) of their rights established by the Law of Ukraine "On the Protection of Personal Data," the purposes of data collection, and that their personal data is transferred to the Seller to facilitate the fulfillment of the Agreement, conduct settlements, and generate invoices, acts, and other documents.

3. PRICE OF GOODS

3.1. The price for each item is listed on the website of the online store.
3.2. The Seller has the right to unilaterally change the price of any item.
3.3. If the price of an ordered item changes, the Seller shall notify the Buyer of the change.
3.4. The Buyer has the right to confirm or cancel the Order if the price changes after the Order is placed.
3.5. Changes in price for goods already paid by the Buyer are not allowed.
3.6. The Seller provides delivery cost information on the website or notifies the Buyer when placing an Order through the Operator.
3.7. Payment obligations of the Buyer are considered fulfilled once funds are received by the Seller.
3.8. Payments between the Seller and Buyer are made as outlined on the website in the "Delivery and Payment" section.

4. ORDERING GOODS

4.1. Orders can be made by the Buyer via phone at +38(098)616-60-66 or through the online store at https://happyluna.com.ua.

4.2. When registering on the website, the Buyer must provide the following information:

Buyer's full name or the name of the recipient.
Address for delivery (if delivery is to the Buyer's address).
Email address (optional).
Contact phone number.

4.3. Product name, quantity, SKU, and price are indicated in the Buyer's cart on the website.

5. DELIVERY AND HANDOVER OF GOODS

5.1. Methods, procedures, and delivery times are outlined in the "Delivery and Payment" section of the website. Delivery terms are agreed upon with the online store's Operator when placing an Order.

5.2. Self-Pickup

After completing an application, the Buyer can pay for and pick up their goods at the following address: Rivne, Fabrichna Street, 16, Monday - Friday, 8:30 AM - 4:30 PM.

5.3. Delivery is performed either by the online store's employees or through third-party carriers.

5.4. Upon receiving the goods, the Buyer must inspect the product in the courier's presence for compliance with quality and quantity (name, quantity, completeness, expiration date).

6. RETURN OF GOODS

6.1. The Buyer has the right to refuse the goods at any time before they are handed over or afterward under the conditions outlined in the Law of Ukraine "On Consumer Rights Protection."

6.5. Refunds for returned goods of proper quality are processed within 7 business days after the online store receives the returned goods.
